Terms of Service

1. Acceptance of Terms

By accessing or using HeartSync (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms in their entirety, you must not use the Service. We reserve the right to update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the revised Terms.

2. Eligibility

You must be:

• At least 18 years of age at the time of registration;
• Legally permitted to enter into a binding contract under the laws of your jurisdiction; and
• Not a person who has previously been banned from the Service.

By creating an account, you represent and warrant that all of the above conditions are met. We may require age verification at any time and may suspend accounts where we have reason to believe a user is under 18.

3. Account Registration

You agree to provide accurate, current, and complete information during registration and to update such information as necessary. You are responsible for safeguarding your account credentials and for all activity that occurs under your account. You must notify us immediately at tony@synapex.io if you suspect unauthorised access.

You may not create more than one account, create an account on behalf of another person, or use automated means to create accounts.

4. Prohibited Conduct

You agree not to:

• Post false, misleading, or impersonating content;
• Harass, threaten, stalk, intimidate, or harm other users;
• Upload or share explicit, pornographic, or sexually graphic content;
• Solicit money or engage in scam activities;
• Send unsolicited commercial messages (spam);
• Use the Service to promote escort services, prostitution, or any illegal activity;
• Post content involving minors in any romantic or sexual context;
• Attempt to reverse-engineer, scrape, or otherwise exploit the Service;
• Use bots or automated scripts to interact with other users;
• Violate any applicable local, national, or international law.

Violation of these rules may result in immediate account termination without refund.

5. User Content

You retain ownership of content you submit to the Service ("User Content"). By submitting User Content, you grant HeartSync a non-exclusive, worldwide, royalty-free licence to host, display, and distribute that content solely for the purpose of operating the Service.

You represent that your User Content does not infringe any third-party intellectual property rights, privacy rights, or any applicable law. We reserve the right to remove any User Content at our discretion and without notice.

6. Premium Subscriptions & Payments

HeartSync offers optional paid Premium plans. By subscribing, you agree to the following:

• Subscriptions renew automatically at the end of each billing period unless cancelled;
• You can cancel at any time via Settings → Subscription; access continues until the end of the current period;
• All payments are processed by third-party providers (Stripe or PayPal) and are subject to their terms;
• Prices are shown inclusive of applicable taxes where required by law;
• Refunds are not provided for partial billing periods, except where required by law.

7. Account Termination

We may suspend or terminate your account at any time, with or without notice, if you violate these Terms or if we reasonably believe your use poses a risk to other users or the Service.

You may delete your account at any time via Settings → Privacy → Delete Account. Upon deletion, your profile and personal data will be removed in accordance with our Privacy Policy.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT MATCHES OR INTRODUCTIONS WILL RESULT IN ANY PARTICULAR OUTCOME.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HEARTSYNC AND ITS DIRECTORS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, LOSS OF PROFITS, OR PERSONAL INJURY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE THREE MONTHS PRECEDING THE CLAIM.

• Access — obtain a copy of the personal data we hold about you;
• Rectification — correct inaccurate personal data;
• Erasure ("right to be forgotten") — request deletion of your data;
• Portability — receive your data in a structured, machine-readable format;
• Objection — object to certain processing activities.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which HeartSync is registered, without regard to its conflict-of-law provisions. Any dispute arising under these Terms shall be submitted to the exclusive jurisdiction of the courts of that jurisdiction.
